The Criminal Court has granted conditional release for Hassan Fawaz, a 21-year-old charged with the murder of Naeema Moosa in N. Manadhoo.
Fawaz was freed from pre-trial detention after a request from the Prosecutor General's Office of the Maldives, which expressed worries about his health situation.
The prosecutor’s office reported that earlier this month, the Maldives Correctional Service notified authorities that Fawaz could not obtain sufficient medical treatment while in detention.
Following medical recommendations, the office pursued his release as a precautionary step to protect his constitutional right to life.
The request was approved by the court after Fawaz consented to a series of stringent conditions.
This entails avoiding any criminal acts, being present at all planned court appearances, and adhering to a curfew that mandates he stay inside from 18:00 p.m. to 08:00 a.m., unless for medical reasons.
He must also check in daily at the closest police station from 08:00 a.m. to 12:00 p.m., except when receiving medical care, and is prohibited from leaving Malé.
Moreover, the court has barred him from reaching out to or trying to sway any witnesses connected to the case.
Fawaz is required to provide updated medical documentation to the prosecutor’s office and the court every 15 days.
Officials indicated that adherence to these stipulations will be carefully overseen by the correctional agency and law enforcement, with any violation probably leading to his re-incarceration.
He is confronted with various accusations, such as deliberate homicide with a cutting instrument, hindering justice, and the improper handling of a corpse.
Prosecutors have signaled that they have collected significant evidence to back the accusations against him.
