Four men have been acquitted for the charge of an assault case that took place in HDh. Kulhudhufushi.

These men have been identified as Ahmed Adam, from Karankaage, Fahudh Mohamed from Aaniru, Fazeel Ali Waheedh of Beachside, and Ali Mahir from Lhosmaage.

Adam was charged for violent behavior with a deadly weapon while participating in an unlawful assembly, whereas the other four were charged with disturbing public order throughout the unlawful assembly all four were present at.

The case leads back to September 25th of 2012, in which an incident took place where an individual named Hassan Mohamed had been allegedly physically assaulted by being hit across the head with a glass bottle. 

Moreover, the state additionally purported that whilst Hassan had been travelling via motorcycle with another person, in order to receive medical attention for his injuries from the assault, the ride there was intercepted by Adam who allegedly drew a knife from his person, and attempted to assault them.

The court noted that none of the victims, as well as the prosecution witnesses were able to vividly recall the incident due to how much time has passed since the incident took place. In addition, the witnesses stated they had not seen the defendants participating in the assault.

While medico-legal reports confirmed that the victims sustained injuries, the evidence was insufficient to establish beyond a reasonable doubt that the defendants caused them. 

The court ultimately made the decision of acquitting all four individuals, ruling that the prosecution failed to prove the charges beyond a reasonable doubt as required by Article 51(h) of the Constitution.
