The Civil Court has determined that the property section owned by Male’ City Mayor Adam Azim at H. Maadhoofiyaa, K. Male’, and given to his wife through an Inter Vivos Transfer (Hiba) according to Islamic Sharia, is legitimate.

The ruling indicates that Azim’s portion of the buildings and land at H. Maadhoofiyaa, specifically 871.25 square feet of private land, was officially divided from his estate and conveyed to his spouse, Aishath Nasheeda of Chambeyleemaage/Male’. The court observed that the transfer met the essential criteria of hiba: a willing donation, explicit acceptance, and finalization of the transfer.

Judge Ali Abdullah pointed out that Azim’s mother, Aishath Moosa, and his daughter had no objections to the gift, strengthening that the transfer adhered to both family-consent practices and Shariah procedural requirements.

The ruling states that Azim and his legal dependents will be housed at Seenukarankaage, K. Male’.

The court also mentioned that the land was neither mortgaged nor leased, and that Azim had no established debt that would hinder a hiba transfer. It was also observed that no claims or complaints were made by any party following the public announcement urging anyone who asserts ownership of the land.

The Civil Court highlighted that Maldivian law imposes no restrictions on gifting property to a spouse, and that hiba is still an officially acknowledged method for transferring ownership.

As a result, Azim’s portion of H. Maadhoofiyaa is now lawfully owned by his spouse, Aishath Nasheeda.
